MONTGOMERY, Ala. (WDNews) – A Montgomery County Circuit Court judge has granted a temporary restraining order requested by Governor Kay Ivey and House Speaker Nathaniel Ledbetter against a rule from the Alabama High School Athletic Association (AHSAA) tied to the state’s CHOOSE Act.
The order prevents the AHSAA from enforcing any policy that makes acceptance of CHOOSE Act funds the sole factor in determining a student-athlete’s eligibility. All other AHSAA rules remain in effect.
The ruling comes after the AHSAA required student-athletes who transferred schools under the CHOOSE Act to sit out one year before competing. The law itself states that nothing in it should affect athletic eligibility.
Governor Ivey said the decision restores fairness and ensures students can pursue both academics and athletics. Speaker Ledbetter added that the ruling protects student-athletes’ right to compete while the lawsuit continues in court. The order will remain in place while the case moves forward.
